Summary
In 2002 the European Commission published a Recommendation on Relevant Product and Service Markets within the electronic communications sector susceptible to ex ante regulation in accordance with Directive 2002/21/EC of the European Parliament and of the Council on a common regulatory framework for electronic communication networks and services. The scope of this paper is to give an overview of the results of the market reviews with regard to market definition, market analysis and remedies in the EU 25 countries of the fixed and mobile markets included in the Recommendation (excluding wholesale international roaming). At the beginning, a short comparative overview of the market reviews of the national regulatory authorities is given. In the following, the markets and countries are surveyed in more detail. It is examined to what extent Member States followed the recommendations of the European Commission in the field of market definition and if they identified operators with significant market power (SMP). In the case that the respective national regulatory authorities identified SMP operators, they have to impose remedies. The ex ante obligations imposed on SMP operators are described in detail. For reasons of clarity and easier comparability between the Member States, the paper provides comparative tables for market definition, market analysis (SMP designation) and remedies (ex ante obligations imposed on SMP operators).
